HB4315 - Agritourism Liability Act

• Creates liability protections for agritourism operators who post required warning notices, shielding them from lawsuits for injuries or deaths resulting from inherent risks of agritourism activities.

• Defines "inherent risks" to include land conditions, natural features, animal behavior, equipment hazards, and participant negligence such as failing to follow instructions or exercise reasonable caution.

• Participants assume inherent risks by engaging in agritourism activities and cannot recover damages from operators for injuries from those risks, except in cases of willful or wanton disregard for safety.

• Agritourism operators remain liable if they knew or reasonably should have known of unusual dangerous conditions or animal propensities and failed to disclose them to participants.

• Requires operators to post and maintain a visible warning notice at or near the entrance to agritourism activities informing participants of assumed risks and operator liability limitations under state law.
