HB4726 Summary

• Requires prior approval from the Illinois Commerce Commission before any property belonging to a public utility providing water or sewer service subject to ICC jurisdiction may be taken or damaged by eminent domain.

• Adds new subsections (g-5) to Section 11-124-5 and (b) to Section 11-139-12 of the Illinois Municipal Code establishing the ICC approval requirement for water and sewer system acquisitions.

• Adds new subsection (h) to Section 10-5-10 of the Eminent Domain Act implementing the same ICC approval requirement for eminent domain actions affecting water or sewer utilities.

• Exempts all eminent domain actions commenced prior to the effective date of this amendatory act from the new ICC approval requirement.

• Becomes effective immediately upon enactment.
