SB0174 - In-Office Membership Care Act

• Establishes a regulatory framework for dental care membership agreements where patients pay periodic direct fees for provider access and routine services instead of traditional fee-for-service or insurance-based care.

• Requires in-office membership care agreements to be written contracts identifying the provider(s), patient(s), scope of services, service locations, direct fee amounts and payment intervals, and termination conditions.

• Prohibits billing to insurance companies for services provided under these agreements and requires agreements to include a disclaimer that they do not constitute health insurance coverage.

• Exempts in-office membership care agreements from regulation as insurance under the Illinois Insurance Code, provided they comply with the Act's requirements.

• Allows patients to terminate agreements at will by written notice and prohibits providers from selling or transferring agreements without patient written consent.
