SB0199 Summary

• Amends the Illinois Controlled Substances Act to add fentanyl possession penalties as a new subsection (1.5) with mandatory minimum and maximum sentences based on quantity: 4-15 years for 15-100 grams, 6-30 years for 100-400 grams, 8-40 years for 400-900 grams, and 10-50 years for 900+ grams.

• Establishes fentanyl sentencing parity with heroin by creating identical quantity-based sentencing tiers that treat fentanyl violations as Class 1 felonies.

• Allows fines up to $200,000 or full street value of controlled substances (whichever is greater) for violations involving 100 grams or more of fentanyl.

• Maintains existing sentencing provisions for other controlled substances including heroin, cocaine, morphine, LSD, and various other Schedule I and II drugs.
