Requires the Department of Human Services to conduct an assessment 90 days before conditional release expiration to evaluate a defendant's continuing need for mental health services.

Mandates the Department create a detailed plan for appropriate mental health services and provide or arrange funding to ensure those services are available to the defendant following release.

Prohibits extension of conditional release beyond the initial period unless there is clear and convincing evidence the defendant will not participate in court-ordered mental health services and would reasonably be expected to inflict serious physical harm without those services.

Applies to persons found not guilty by reason of insanity who are subject to conditional release periods, with extensions possible in 5-year increments based on court hearings.
