School districts must allow students with asthma action plans, Individual Health Care Action Plans, food allergy emergency action plans, Section 504 plans, or IDEA plans to self-administer prescribed medications with written parental permission and physician authorization.

Parents must provide the school district with written permission for self-administration, physician authorization, and the prescription label containing medication name, dosage, and administration times or circumstances.

School districts must adopt an emergency action plan for students who self-administer medication, including procedures for when a student cannot self-administer and situations requiring a 9-1-1 call.

School districts and employees are protected from liability except for willful and wanton conduct; parents must sign an indemnification statement agreeing to hold the school harmless from claims arising from medication self-administration.

Teachers and non-administrative school employees cannot be required to administer medication to students, except certified school nurses and non-certificated registered professional nurses.
