SB1256 Summary

• Prohibits diesel-fueled motor vehicles with gross vehicle weight rating of 8,000 pounds or more from idling more than 10 minutes within any 60-minute period in specified Illinois counties and townships (Cook, DuPage, Lake, Kane, McHenry, Will, Madison, St. Clair, Monroe, and parts of Grundy and Kendall counties).

• Establishes 17 exemptions including traffic-related idling, emergency vehicles, auxiliary equipment operation, buses (up to 15 minutes for passenger comfort), vehicles with sleeping berths, and extreme temperature conditions (below 32°F or above 80°F).

• Allows up to 30 minutes of idling within any 60-minute period during moderate temperatures when waiting to weigh, load, or unload cargo if the vehicle is in a regularly moving line.

• Penalizes violations with a $90 fine for first offense and $500 for subsequent offenses within 12 months, with fines distributed to the State General Revenue Fund, law enforcement agencies, and a new Trucking Environmental and Education Fund.

• Adds restrictions on idling at paid parking properties (without fuel dispensing) in counties over 3 million residents but outside municipalities over 2 million residents when within 200 feet of residential areas, with exemptions for school buses, waste haulers, IDOT facilities, public utilities, and ambulances.
