IL SB1380

Amends the Criminal Code of 2012 to add a new subsection (a-5) defining second degree murder as committing any criminal act that causes or results in responsive actions by a first responder, where that first responder is killed as a proximate cause of responding to the criminal act.

Maintains existing second degree murder provisions under subsection (a), which apply when a person commits first degree murder with either sudden and intense passion from serious provocation or unreasonable belief that circumstances justify the killing.

Specifies that sexual orientation, its discovery, knowledge, or disclosure cannot constitute serious provocation for purposes of the second degree murder charge.

Preserves the burden of proof framework where the defendant must prove mitigating factors by a preponderance of the evidence, while the State must prove first degree murder elements beyond a reasonable doubt.

Classifies second degree murder as a Class 1 felony.
