SB1424 Summary

• Amends the Workers' Compensation Act to authorize recording of employee medical examinations with consent of both the employee and physician for use as evidence.

• Establishes a collective bargaining pilot program allowing the Department of Labor to designate 2 construction labor organizations to negotiate alternative dispute resolution systems and other workers' compensation procedures with construction employers.

• Permits collective bargaining agreements between construction employers and participating labor organizations to include provisions for alternative dispute resolution, agreed medical provider lists, independent medical examinations with recording capability, light duty programs, vocational rehabilitation, and joint safety committees.

• Prohibits any collective bargaining agreement provisions from diminishing or increasing the substantive entitlements or benefits otherwise guaranteed to employees and employers under the Workers' Compensation Act.

• Requires ADR plan administrators to file claims with the Commission, maintain records, and submit annual reports containing data on employees, injuries, benefits paid, and claim dispositions within the program.
