SB1462 Summary

• Expands public indecency offense under Criminal Code to include acts committed while confined in a penal institution, in addition to acts in public places.

• Excludes facilities of the Department of Juvenile Justice and juvenile detention facilities from the definition of "penal institution" for purposes of the public indecency statute.

• Adds a second violation or attempted violation of public indecency while confined in a penal institution committed on or after the bill's effective date to the definition of "sex offense" requiring registration under the Sex Offender Registration Act.

• Maintains existing penalties: public indecency is a Class A misdemeanor, a third or subsequent violation is a Class 4 felony, and commission within 500 feet of school grounds where children are present is a Class 4 felony.
