IL SB1504

Amends Section 5-105 of the Code of Civil Procedure to establish a tiered system for waiving court fees, costs, and charges based on applicant income levels relative to the federal poverty level.

Grants full waiver of all fees, costs, and charges to indigent persons meeting criteria including receipt of means-based public benefits or income at or below 125% of poverty level.

Establishes partial waivers waiving 75%, 50%, or 25% of fees for applicants with income between 125-200% of poverty level, unless assets demonstrate ability to pay more without undue hardship.

Requires courts to provide simplified waiver applications to all persons indicating inability to pay, and mandates posting of 8.5 x 11 inch notice in English and Spanish at courthouses informing public of waiver availability.

Allows courts to reconsider waivers if evidence suggests initial ineligibility or changed financial circumstances, but only once every 6 months with at least 10 days' written notice to the applicant.
