IL SB1609

Increases daily incarceration credit from $5 to $30 per day for defendants incarcerated on bailable offenses who do not supply bail and are convicted with a fine, capped at the fine amount.

Excludes persons incarcerated for sexual assault from receiving the incarceration credit under subsection (a).

Requires sheriffs to deduct $30 per day from a defendant's 10% cash bond amount for Category B offenses and release the defendant on their own recognizance once the bond reaches $0.

Allows courts to deny the incarceration credit if a defendant failed to appear in court and was incarcerated on a warrant for failure to appear on the same original criminal offense.

Removes the provision requiring credit for time served to be divided between fines and assessments; credit now applies first to fines only.
