Allows courts to divert first-time misdemeanor theft and retail theft offenders into a Misdemeanor Retail Theft and Theft Diversionary Program with consent of defendant and State's Attorney.

Program duration is minimum 12 months with proceedings suspended during participation; defendants must not violate any criminal statute, refrain from possessing firearms or dangerous weapons, and make full restitution plus 10% of stolen item value.

Court may order defendants to attend theft awareness or shoplifting classes online or in person at its discretion.

If defendant fails to complete program or violates conditions, State's Attorney can move to terminate diversion and continue case for arraignment and normal criminal proceedings.

Upon successful program completion, State's Attorney must dismiss the case or court must discharge and dismiss proceedings; defendants limited to one such discharge and dismissal within any 3-year period.
