SB2025 Summary

• Requires school districts to notify parents or guardians when their child begins receiving Response to Intervention (RtI) support more intensive than universal instruction and allow parental participation in the process.

• Mandates that parent or guardian notification include the specific problems being addressed, student performance goals, reasons for moving to more intensive intervention, and how to access progress reports and data.

• Establishes that parents or guardians have the right to request a special education evaluation at any time for children receiving RtI support above the universal level, and school districts cannot deny such requests solely because the child is receiving RtI.

• Requires school districts to request parental or guardian consent for a case study evaluation to determine special education eligibility if a student has been in the highest level of RtI support for 45 consecutive school days without showing meaningful, measurable progress toward established performance goals.

• Defines Response to Intervention as a 3-tiered model using differentiated instructional strategies, scientifically research-based interventions, and continuous performance monitoring to make educational decisions based on student response.
