SB2076 Summary: Illinois Code of Military Justice Amendments

• Reorganizes and clarifies military justice offenses by restructuring 30+ articles of the Illinois Code of Military Justice, including charges related to lesser included offenses, conspiracy, malingering, and breach of quarantine.

• Adds new articles addressing prohibited sexual activities with recruits or trainees by personnel in positions of special trust, including military recruiters engaging in inappropriate conduct with applicants or delayed entry program members.

• Establishes new offenses for resistance/flight from apprehension, escape from custody, disrespect toward sentinels/lookouts, false or unauthorized military documents, impersonation, wearing unauthorized insignia, and parole violations.

• Creates offenses for communicating threats (including threats involving explosives or weapons of mass destruction), accessing government computers without authorization, fraudulent enlistment or separation, and retaliation against those reporting crimes or making protected communications.

• Reserves multiple article numbers (87b, 103a, 109a, 119a-122a, 124a-124b, 128a, 131a-131e) for future use and takes effect upon becoming law.
