By October 1, 2022, the Department of Human Services must transfer all individuals with intellectual or developmental disabilities from non-Medicaid certified facilities to either the Home and Community-Based Services Waiver Program or Medicaid-certified residences.

Prior to transfer, each individual must be evaluated by an independent multidisciplinary clinical team and an independent service coordination agency to develop a person-centered plan with funding equal to their current non-Medicaid facility allocation.

The Department must submit annual reports to the General Assembly and Governor (beginning March 1, 2020) detailing the number of individuals transferred, types of settings they moved to, and net savings achieved including Medicaid matching funds.

Net savings realized from transfers must be reinvested in community-based residential and support services for individuals with intellectual and developmental disabilities.

Exempts individuals ordered into Department custody by court for whom non-Medicaid facilities are deemed appropriate for forensic treatment; requires regular compliance visits and reports on remaining non-Medicaid facilities.
