SB2323 Summary

• Removes obsolete language requiring a statewide study of behavioral interventions with students with disabilities, effectively eliminating that 1993 mandate.

• Requires school boards to establish policies and procedures on behavioral interventions for students with disabilities, including requirements that individualized education programs be followed and interventions include functional behavioral analysis.

• Establishes specific rules for time outs and physical restraint: may only be used as behavioral intervention techniques (not punishment), doors must remain unlocked during enclosures, students must be supervised by trained adults, and all uses must be reported to the State Board of Education within 48 hours with demographic information.

• Requires school boards to provide copies of behavioral intervention policies to parents and guardians within 15 days of adoption or amendment, and to explain policies at annual individualized education program reviews.

• Allows complaints about violations to be filed with the State Superintendent of Education and requires demographic data (gender and race/ethnicity) on all reported time outs and physical restraints to be disaggregated by the State Board of Education.
