Recipients at Department of Human Services facilities gain the right to request transfers to different Department facilities by submitting written applications to their facility directors.

Recipients, their attorneys, guardians, and responsible relatives can request transfer forms from the Department, with hearings scheduled within 7 days at the recipient's current facility.

Recipients must prove at hearings that the requested facility is less restrictive and more clinically appropriate, and that the transfer does not threaten safety of the recipient or others.

If a transfer application is denied, recipients cannot file another application for 180 days, but retain the right to administratively appeal utilization review committee decisions.

Recipients with primary diagnoses of developmental disabilities are excluded from the transfer request process.
