SB2909 - Renters' Right to Recycle Act

• Requires owners of multifamily dwellings (2 or more units) to arrange for recycling services including on-site paper, plastic, and aluminum recycling containers for tenants.

• Exempts building owners from recycling requirements if there is inadequate space (certified by a waste enterprise), no waste enterprise provides recycling services in the area, or recycling costs increase expenses by 30% or more compared to solid waste services alone.

• Directs the Illinois Environmental Protection Agency to implement, administer, and enforce the Act, adopt necessary rules, and investigate resident complaints about violations.

• Authorizes the Agency to assess civil penalties against owners who violate the Act or its implementing rules, with penalty amounts determined by the Agency.

• Takes effect July 1, 2021, and does not prevent local governments from imposing additional or stricter recycling requirements.
