SB2998 Summary

• Requires owners/operators of livestock management facilities with less than 1,000 animal units to prepare and maintain a waste management plan (previously exempt).

• Mandates waste management plans for facilities with 5,000+ animal units be filed electronically with both the Illinois Environmental Protection Agency and Department of Agriculture (previously only Department of Agriculture).

• Reduces compliance period for facilities issued warnings from 30 working days to 15 working days to prepare a waste management plan.

• Makes issuance of operational cease and desist orders mandatory (rather than discretionary) by the Department following a second violation for failure to prepare and maintain a waste management plan.
