SB3010 Summary

• Extends hospital provider assessment and related payment programs from July 1, 2020 to July 1, 2022, covering State Fiscal Years 2021-2024 with assessments on inpatient and outpatient services based on non-Medicaid gross revenue.

• Modifies the Emergency Medical Services Systems Act to remove provisions requiring automatic Freestanding Emergency Center licenses for hospitals that discontinue inpatient services and meet other requirements (blanks subsection a-20 of Section 32.5).

• Authorizes the Department of Healthcare and Family Services to use emergency rulemaking to implement hospital assessment and payment changes, with authority repealed January 1, 2026.

• Establishes a hospital transformation program with Phase 1 (FY2019-2020), Phase 2 (FY2021), and Phase 3 (FY2022 onward) to provide financial assistance to hospitals in high-need areas and areas affected by health disparities, with allocation from transitional access hospital pool and $120 million annually from Hospital Provider Fund.

• Requires managed care organizations to pass through increased capitation payments to hospitals in accordance with federal regulations and establishes a health disparities pay-for-collection pool (up to $20 million annually) for collection of patient-level demographic data to measure and address health disparities.
