IL SB3127

Amends the Illinois Governmental Ethics Act to establish how partisanship is determined for gubernatorial appointees to offices that require specific party affiliation or limit appointees from a single party.

Partisanship is determined by the appointee's voting record in the 3 general primary elections immediately preceding their appointment, based on which partisan ballot they requested.

An appointee is deemed independent if they did not vote, did not request a partisan ballot, or requested partisan ballots from 2 or more different political parties in those 3 primary elections.

After appointment, an individual cannot be disqualified from continuing in office or holding over based on their voting in primary elections after their appointment date.

This provision applies to all gubernatorial appointments on or after the effective date of this Act, including acting and temporary appointments.
