IL SB3166

Amends the Unified Code of Corrections to add pregnancy and parental status as mitigating factors in sentencing decisions under 730 ILCS 5/5-5-3.1.

Establishes that defendant's status as pregnant person or parent of child/infant whose well-being will be negatively affected by parent's absence shall be accorded weight in favor of withholding or minimizing imprisonment sentences.

Requires courts to consider specific circumstances when assessing this mitigating factor, including: child's age, breastfeeding status, parent's role in child's education and medical care, parent-child relationship, child's special needs, financial support role, and best interest of the child.

Adds consideration of likelihood that child will be adjudged dependent minor and declared ward of court under Juvenile Court Act of 1987 as relevant circumstance.

Permits defendants to present Family Impact Statement at sentencing; requires court to impose sentence allowing parent to continue caring for child unless court finds parent poses significant community risk outweighing harm from parent's removal from family.
