IL SB3305

Amends the County Jail Act to require the State to reimburse counties for costs of maintaining incarcerated persons ordered by court into Department of Human Services (DHS) custody for mental health treatment if DHS does not provide bed space within 30 days of sheriff notification.

Reimburses counties for all maintenance costs incurred after the 30-day period expires for persons awaiting DHS mental health facility placement.

Applies to persons charged with offenses held in county jail and ordered to DHS custody under Section 104-17 of the Code of Criminal Procedure of 1963.

Also applies to persons sentenced to misdemeanor terms, county impact incarceration under the Counties Code, or periodic imprisonment at county jail, and ordered to DHS custody for mental health treatment under the Unified Code of Corrections or Mental Health and Developmental Disabilities Code.
