SB3322 Summary

• Excludes minors age 16 and older from juvenile court jurisdiction if charged with aggravated vehicular hijacking under subdivisions (a)(4), (a)(5), or (a)(6) of Section 18-4 of the Criminal Code of 2012, or armed robbery under subdivisions (a)(2), (a)(3), or (a)(4) of Section 18-2 of the Criminal Code of 2012.

• Requires these charges and all related charges from the same incident to be prosecuted under adult criminal laws rather than juvenile court procedures.

• Maintains existing excluded jurisdiction for minors age 16+ charged with first degree murder, aggravated criminal sexual assault, and aggravated battery with a firearm.

• Allows State's Attorney to pursue lesser charges in juvenile court only if the minor waives the right to juvenile court prosecution in writing with counsel present.

• Requires minors under 18 to be kept separate from confined adults, and preserves court discretion to sentence under juvenile or adult provisions depending on circumstances and factors such as the minor's age, history, and public safety.
