Creates the Energy Performance Contracting Act requiring all State agencies, authorities, and political subdivisions (excluding local governments and school districts) to implement cost-effective energy conservation improvements and conduct energy audits to minimize energy consumption and reduce operating costs

Designates the Smart Energy Design Assistance Center (SEDAC) at the University of Illinois at Urbana-Champaign as the lead agency to develop standardized contract processes, assist governmental units with project implementation, and charge fees up to 2% of total project cost for services

Allows governmental units to enter energy performance contracts with qualified providers for up to 25 years, with guaranteed savings contracts requiring annual savings to meet or exceed total contract payments including financing charges

Requires the Capital Development Board to maintain a list of qualified energy service providers evaluated on criteria including project experience, management capability, ability to access financing, and post-installation monitoring capabilities

Amends the Illinois Procurement Code to conform with the new Act and repeals Section 25-45, with provisions stating this Act takes precedence over conflicting laws
