SB3340: Telemarketing Disclosure and Privacy Act

• Creates the Telemarketing Disclosure and Privacy Act to regulate telemarketer conduct regarding caller identification devices and services.

• Prohibits telemarketers from interfering with, circumventing, or obstructing caller identification services or devices from providing call origin information to recipients.

• Prohibits telemarketers from failing to provide caller identification information in an accessible manner or transmitting misleading information about call origin.

• Allows telemarketers to substitute the name and telephone number of the party on whose behalf the call is made in place of their own information without violating the Act.

• Authorizes the Illinois Commerce Commission to investigate violations and impose administrative penalties of up to $1,000 per violation; takes effect immediately upon becoming law.
