SB3357 - Kratom Consumer Protection Act

• Creates the Kratom Consumer Protection Act establishing safety and labeling requirements for kratom products containing Mitragyna speciosa leaf.

• Requires dealers to disclose factual basis on product labels for kratom representations and prohibits sale of kratom products that do not conform to required disclosures.

• Prohibits dealers from selling kratom products that are adulterated with dangerous substances, contaminated with controlled substances or poisons, contain synthetic alkaloids, exceed 2% 7-hydroxymitragynine in alkaloid composition, or lack adequate labeling and certification.

• Prohibits dealers from selling or distributing kratom products to individuals under 18 years of age.

• Establishes penalties including administrative fines up to $500-$1,000 for disclosure violations and Class B misdemeanor charges (up to 90 days imprisonment and $500 fine) for substantive violations, with private right of action for damages.
