SB3390 - Water Quality Assurance Act

• Creates the Water Quality Assurance Act requiring new and existing health care facilities to develop and implement water management programs to control opportunistic pathogens, including Legionella bacteria, with specified elements like hazard analysis, control measures, and documentation requirements.

• Mandates routine culture sampling of all building water systems at minimum once every 6 months, with Legionella analysis by CDC-certified laboratories, and requires health care facilities to perform remediation when opportunistic pathogens are detected.

• Establishes the Water Quality Assurance Fund as a special state treasury fund to support Department of Public Health implementation and enforcement, with fees from facility registration and professional certifications deposited into the fund.

• Requires health care facilities to register all building water systems with the Department within 120 days of the Act's effective date, providing detailed information about system location, ownership, maintenance, and operational specifications.

• Amends the Illinois Procurement Code to exempt Department of Public Health procurement expenditures necessary for infectious disease outbreak response and State agency facility procurement for critical outbreak-related recommendations from standard procurement procedures.

• Takes effect January 1, 2021.
