SB3421 Summary

• Creates the Executive Order 3 (2017) Implementation Act to transfer the Office of Energy and Recycling from the Department of Commerce and Economic Opportunity to the Environmental Protection Agency, effective immediately upon enactment.

• Transfers all powers, duties, rights, responsibilities, employees, records, contracts, and funds associated with the Office of Energy and Recycling to the Environmental Protection Agency.

• Excludes from transfer electric energy efficiency programs under Section 8-103 of the Public Utilities Act and natural gas efficiency programs under Section 8-104 of the Public Utilities Act, which remain with the Department of Commerce and Economic Opportunity.

• Designates the Environmental Protection Agency Director or designee to serve on any councils, commissions, boards, or entities where the Department of Commerce and Economic Opportunity previously held membership related to transferred functions.

• Makes corresponding statutory amendments across multiple Illinois codes including the Electric Vehicle Act, Renewable Energy Act, Illinois Solid Waste Management Act, Recycled Newsprint Use Act, and Prevailing Wage Act to reflect the agency transfer.
