Amends the Right to Privacy in the Workplace Act to expand when employers can take action against employees for using lawful products (such as cannabis or alcohol)

Changes the exception language from products "which impairs" to products "that could impair or is impairing" an employee's ability to perform assigned duties

Allows employers to act based on potential impairment, not just actual demonstrated impairment at the time of employment action

Maintains existing protections prohibiting employers from discriminating against employees who use lawful products off-premises during non-working and non-call hours

Preserves exceptions for non-profit organizations that discourage use of lawful products as a primary purpose
