IL SB3579

Amends the Criminal Code of 2012 to add new subsection (d) to Section 11-1.70 regarding defenses to sexual offense charges.

Eliminates consent as a viable defense when a health care provider or mental health care provider is charged with criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, criminal sexual abuse, or aggravated criminal sexual abuse.

Applies the consent elimination only when the victim is a client or patient of the accused provider and the sexual conduct or penetration occurs during a treatment session, consultation, interview, or examination.
