IL SB3596

Amends the Code of Civil Procedure Section 2-206 to shift responsibility for sending publication copies from the court clerk to the plaintiff or plaintiff's attorney in mortgage foreclosure actions (Part 15 of Article XV).

Requires the plaintiff or attorney to send a copy of the publication notice to each defendant within 10 days of first publication and to file a certificate of mailing with the court clerk's office.

Changes the evidentiary standard so that the plaintiff's or attorney's certificate (rather than the clerk's certificate) serves as evidence that publication copies were sent to defendants.

Designates sending notice copies as a non-delegable duty of the plaintiff or attorney in mortgage foreclosure proceedings.

Maintains existing publication requirements in newspapers published in the county where the action is pending, or in an adjoining county if no local newspaper exists.
