IL SB3776

Amends the Biometric Information Privacy Act (740 ILCS 14/20) to modify damages recovery for negligent violations by private entities.

Establishes $1,000 liquidated damages or actual damages (whichever is greater) for negligent violations by private entities that are not current or former employers of the prevailing party.

Limits recovery to actual damages only for negligent violations by private entities that are current or former employers of the prevailing party.

Maintains $5,000 liquidated damages or actual damages (whichever is greater) for intentional or reckless violations by private entities.

Preserves the right to recover reasonable attorney's fees, costs, expert witness fees, and other relief including injunctions.
