SB3788 Summary

• Changes the name of "sex education" to "sexual health education" throughout the School Code and related statutes.

• Requires comprehensive sexual health education in grades 6-12 to include instruction on anatomy, healthy relationships, identity, personal safety, pregnancy/reproduction, puberty, and sexually transmitted infections including HIV, with material that is medically accurate, evidence-based or evidence-informed, culturally appropriate, and age-appropriate.

• Specifies that sexual health education must teach abstinence as the only 100% effective prevention method while also providing information on FDA-approved contraceptive methods, PrEP, PEP, and vaccination to reduce STI and unintended pregnancy risk.

• Mandates instruction on consent, including that consent is freely given, can be withdrawn, and cannot be assumed based on clothing, past activity, or submission to force; also requires age-appropriate discussion of sexual abuse, assault awareness, and prevention in pre-K through 12.

• Allows parents or guardians to opt their child out of comprehensive sexual health education by submitting written objection, with no penalty to the student; requires State Board of Education to provide free sample curricula and annual reporting to General Assembly on sexual health education programs.
