SB3861 Summary

• Creates the Right to Counsel in Immigration Proceedings Act to establish a Task Force on Counsel in Immigration Proceedings consisting of 7 members appointed by the Governor in consultation with legislative leaders and state officials.

• Task Force shall investigate implementation of universal legal representation for covered individuals in immigration removal proceedings, including estimating the number of individuals needing representation, current legal infrastructure gaps, required additional resources, and annual costs.

• Task Force must provide findings on different representation scopes by categories including state domiciliaries versus non-state domiciliaries, household income above/below 250% of federal poverty line, types of proceedings, and current representation percentages.

• Task Force shall submit report with findings and recommendations for providing full legal representation to covered individuals by July 1, 2021.

• Act is repealed July 1, 2022 and takes effect immediately upon becoming law.
