SB4009 Summary: Small Wireless Facilities Deployment Act Amendments

• Requires wireless providers to submit additional documentation with permit applications, including written affidavits from radio frequency engineers, acoustic analysis reports, FCC environmental review information, and certified easement documents demonstrating installation rights.

• Increases the distance threshold for authorities to propose alternate collocation sites from 100 feet to 200 feet of the proposed location and clarifies that changes varying in design, power output, frequency, or location are not "substantially similar" replacements exempt from permitting.

• Allows authorities to adopt reasonable rules requiring providers to place above-ground small wireless facilities and associated equipment below ground and to replace larger, more visually intrusive facilities with smaller alternatives where technologically compatible and commercially available.

• Establishes radio frequency compliance requirements in new Section 45, including mandatory FCC standards compliance, provider monitoring and quarterly or annual certification reporting, authority testing rights, and $750 daily fines for violations not cured within 3 calendar days.

• Effective immediately upon enactment.
