IL SB4031

Amends the Illinois Municipal Code to permit tobacco product and tobacco accessory sales licenses within 100 feet of private elementary schools in municipalities with populations exceeding 1,000,000 inhabitants.

Applies only to schools located within boundaries of West Devon Avenue, West Rosemont Avenue, North Mozart Street, and North Fairfield Avenue.

Requires tobacco sales at qualifying premises to occur only after school hours and end by no later than 2 a.m.

Prohibits home rule municipalities from regulating tobacco license issuance or renewal in a manner inconsistent with these provisions, limiting their home rule powers.

Takes effect upon becoming law.
