Department of Employment Security is urged to collect data on employer misclassification incidents, including job titles, employment industry, wages, hours, and unemployment benefits paid from the state unemployment fund.

"Employer misclassification" is defined as a worker classified as an independent contractor paid 1099 wages but later deemed by IDES to qualify as an employee under Illinois unemployment law.

Department of Employment Security is urged to collect data on applicants qualifying for Pandemic Unemployment Assistance as self-employed, independent contractors, and sole proprietors, including job titles, industry, hours, and wages.

Collected data must be presented in electronic format that excludes personally identifying information and shared with the Illinois Senate on or before the last day of the 101st General Assembly.

Resolution recognizes that worker misclassification denies Illinois workers basic labor standards including wage and hour protections, health and safety standards, workers' compensation, and unemployment insurance.
