HB0041 Summary

• School districts must refer parents/guardians to in-state special education residential facilities comparable to out-of-state facilities before placing children out-of-state, and must annually review out-of-state placements with this option available.

• Placing agencies or courts must review annually the placement of children in out-of-state special education residential facilities and refer the option of comparable in-state facilities to the child or parent/guardian as part of that review.

• School districts remain responsible for educational costs of residential facility placements made or funded by state agencies or courts, with reimbursement calculated per Section 14-7.02 of the School Code.

• The Illinois Purchased Care Review Board must approve rates for out-of-state non-public providers offering integrated autism-specific educational and residential services with 2+ care levels and serving 12 or fewer Illinois students.
