Creates the Medical Device Safety Act requiring all medical devices used by, surgically applied to, or implanted within patients in Illinois to be under warranty, regardless of the patient's medical condition severity

Holds manufacturers, sellers, and providers of medical devices liable for all replacement costs when devices malfunction through no fault of the patient

Requires all hospitals and ambulatory surgical treatment centers to waive costs charged to patients for follow-up surgeries resulting from defective medical devices

Amends the University of Illinois Hospital Act, Ambulatory Surgical Treatment Center Act, and Hospital Licensing Act to mandate that facilities waive costs for follow-up surgeries resulting from previous surgical errors

Takes effect immediately upon becoming law
