HB0090 Summary

• Creates a traffic ticket fine waiver program for defendants unable to pay fines, fees, costs, court assessments, or who have a suspended driver's license from minor traffic offenses committed within 2 years before the bill's effective date.

• Defendants may petition the court to either convert the amount due into court-approved public or community service (at $10 per hour of service) or receive a partial obligation waiver.

• Provides 50% waiver for all applicants, or 80% waiver for defendants with income at or below 125% of the federal poverty level or receiving means-based public benefits (SSI, TANF, SNAP, General Assistance, etc.).

• Requires courts to immediately notify the Secretary of State of defendant participation in the program so the Secretary can reinstate suspended or revoked driver's licenses if applicable.

• Amends Section 6-204 to require courts to notify the Secretary of State when a defendant enters the program, and amends Section 16-104e to allow fine waivers under this new program as an exception to the minimum penalty requirement.
