HB0166 - Carbon Dioxide Geologic Storage Act

• Storage operators must obtain a reservoir permit from the Department of Natural Resources to operate carbon dioxide geologic storage facilities for injections commencing on or after January 1, 2021.

• Storage operators must pay a fee of $0.08 per ton of carbon dioxide estimated to be injected, with renewal fees based on amounts exceeding prior estimates; fees are deposited into the Illinois Geologic Sequestration Special Fund.

• Storage operators must own all pore space in a storage facility or own more than 50% and apply to the Department to amalgamate remaining interests through a fair market value hearing process.

• Upon completion of injections, the storage operator may apply for a certificate of completion; once issued, title to the storage facility and stored carbon dioxide transfers to the State, which assumes long-term monitoring and management responsibilities.

• The Department of Natural Resources has exclusive regulatory authority over geologic storage, and the Act does not apply to carbon dioxide used for enhanced oil or gas recovery projects.
