HB0190 - Blight Mitigation Act Summary

• Creates the Blight Mitigation Act to address abandoned residential properties in Illinois.

• Allows property owners living within one-fourth mile of and on the same street as an abandoned property to petition a court for title transfer after 12 months of continuous abandonment.

• Court must transfer title if petitioner proves by clear and convincing evidence that: (1) property is abandoned; (2) original owner is properly notified; and (3) property is not listed for sale, in receivership, or under contract.

• Defines "abandoned" as property that is tax delinquent for 2 or more years and unoccupied by persons with legal possession rights.
