HB0721 - Diversity in Not-for-Profit Act

• Creates certification framework for three categories of not-for-profit organizations: minority-led, woman-led, and organizations led by persons with disabilities, each requiring 51% representation on board of directors or combined board and key employees.

• Establishes eligibility requirements including tax-exempt status under IRC Sections 501(c)(3) or 501(c)(4), compliance with Solicitation for Charity Act, active engagement in stated activities, independence from non-eligible entities, and not being formed solely to obtain certification.

• Authorizes State agencies, counties, and local governments that operate disadvantaged business enterprise programs to certify eligible not-for-profit organizations and maintain public lists of certified entities.

• Amends Public Utilities Act Section 5-117 to require utility companies and energy suppliers to include minority-led, woman-led, and disability-led not-for-profit organizations in annual supplier diversity reporting alongside traditional business enterprise categories.

• Requires participating utilities and energy suppliers to report annually on procurement goals and spending with certified not-for-profit organizations and include information about vendor enrollment processes and supplier diversity plans.
