IL HB0812

Creates the Local Accessory Dwelling Unit Act to regulate accessory dwelling units (ADUs) at the local government level.

Defines "accessory dwelling unit" as an attached or detached residential unit on the same parcel as a primary residence with independent living facilities, including efficiency units and manufactured homes.

Prohibits units of local government from banning the construction or use of accessory dwelling units within their jurisdiction.

Allows local governments to establish reasonable regulations on ADU size and location similar to other accessory structures, provided such regulations do not have the effect of prohibiting ADUs.

Limits home rule powers by requiring home rule units to regulate ADUs consistently with this Act, establishing it as a constitutional limitation under Article VII, Section 6(i) of the Illinois Constitution.
