IL HB1765

Prohibits law enforcement agencies and their officers from conducting background checks on individuals solely because they are speaking at an open meeting of a public body, including police disciplinary boards

Exempts background checks when law enforcement develops reasonable suspicion of criminal conduct or a threat to security for the meeting premises or attendees

Exempts background checks when the speaker is under consideration for appointment to a government position by that public body

Establishes violation of the prohibition as a Class C misdemeanor

Creates no civil liability or damages for violations of the Act
