Department of Children and Family Services shall pay the DCFS per diem rate for inpatient psychiatric stays at free-standing psychiatric hospitals or hospitals with pediatric or adolescent inpatient psychiatric units starting on the 11th day of hospitalization.

DCFS per diem rate applies when a child is hospitalized beyond medical necessity and the parent or caregiver has denied home access, refused to arrange alternative living arrangements, or the discharge is delayed due to a pending DCFS inquiry or investigation.

Hospital stays reimbursed under this provision are ineligible for payment under Section 14-13 of the Illinois Public Aid Code.

Section is operative from July 1, 2020 through July 1, 2023.

Act takes effect upon becoming law or when Senate Bill 1510 of the 101st General Assembly takes effect, whichever is later.
