HB1849 Summary

• Court cannot place a minor on probation for a subsequent offense involving firearm use or possession if the minor was previously placed on probation for a firearm offense.

• Minor convicted of a subsequent firearm possession or discharge offense not causing injury must be referred to social service programs through Juvenile Probation for at least 3 months, with commitment to Department of Juvenile Justice if referral recommendations are not completed.

• Minor convicted of a subsequent offense involving firearm use causing serious injury, great bodily harm, or death shall be committed to Department of Juvenile Justice with services including education, mental health, drug treatment, and mentoring.
