HB1906 Summary

• Creates a temporary relief program (through July 1, 2031) allowing school districts to discontinue or modify unfunded mandates enacted after August 20, 2010, if mandates are not fully funded by separate state appropriations.

• Requires school boards to conduct public hearings with at least 14 days' notice before discontinuing or modifying mandates, with relief periods not exceeding 5 years.

• Establishes a review process where regional superintendents and the State Superintendent can object to mandate relief based on proof of full funding, availability of free resources, or impacts to student health and safety.

• Prohibits relief from mandates related to special education, teacher licensure and tenure, the Every Student Succeeds Act, and teacher/principal evaluation requirements using student performance data.

• After July 1, 2031, shifts to an annual petition process requiring school districts to request mandate exemptions by February 15 for the following school year, with regional superintendent and state-level appeals available.
